BREMERTON, Wash. — A state prosecutor’s office will seek probation and treatment for a 9-year-old student who took a gun to school that accidentally discharged, critically injuring a classmate last week.

The third-grade boy has been charged with unlawful possession of a gun, bringing a dangerous weapon to school and third-degree assault, the Associated Press reports. At a capacity hearing, a judge will determine if the boy knew what he did was wrong.

Police believe the gun came from the home of the boy’s mother, Jamie Lee Chaffin, a convicted felon.

Amina Kocer-Bowman, 8, was wounded in the shooting.
