The Colorado Court of Appeals ruled in favor of a student advocacy group seeking to allow students with concealed weapon permits to carry guns on campus.
The Students for Concealed Carry on Campus (SCCC) said that a 1994 University of Colorado (CU) policy, which bans concealed weapons, violates state gun laws, according to the Denver Post. In its April 15 ruling, the appeals court referred to a Colorado statute permitting concealed carry except in specific areas ordered by federal law and on K-12 campuses. Other vicinities prohibiting concealed weapons must follow a set of strict security guidelines.
The ruling revives a lawsuit that was dismissed last year; the case will now be re-evaluated to the El Paso County District Court. Moreover, the ruling could affect other Colorado campuses.
Meanwhile, the Rocky Mountain Gun Owners (RMGO) association filed a lawsuit against Colorado State University’s (CSU) concealed carry ban April 16. CSU approved a similar policy to CU’s in February.
Members of the RMGO believe the court will come to the same decision in the CSU case as it did for the CU case despite the fact that the ruling only binds CU because the policy is worded differently than CSU’s.
