Lawyers for 2012 mass shooting suspect James Holmes claim the University of Colorado might have kept under wraps records that showed the institution didn’t act on information it had about Holmes being a threat.

At the time of the July 2012 theater mass shooting, Holmes had just dropped out of the University of Colorado, Denver. His attorneys say the school might have known more about their client’s behavior health issues. They also claim the university possibly could have done more to prevent the tragedy, according to the Associated Press.

Holmes is suspected of killing 12 people and injuring 70 others in an Aurora, Colo., movie theater.

His defense admits that he was the gunman but claim he is mentally ill. Prosecutors are seeking the death penalty.
