A gay teacher is arguing he wasn’t given due process when he was fired from his Arkansas high school after his sex tape was posted on the school’s website.

Brian Cody Bray was fired on Oct. 8 by Maumelle Charter High School after the school investigated the appearance of his sex tape on its website, according to nakedsecurity.com.

Bray claims his Dropbox account was hacked and the sex tape was stolen in what he characterized as a cyber hate crime. A student at the school was also anonymously texted the explicit video’s URL.

Bray was placed on administrative leave on Sep. 28 while the school investigated the incident.

After initially agreeing with the school’s termination decision, Bray now says the school has acted unfairly by denying him severance pay, filing ethics complaints against him and suggesting that he was responsible for the incident.

Although the school has maintained that Bray was at least partially at fault for the incident, the Arkansas Professional Licensure Standards Board cleared Bray after determining there was insufficient evidence in his case.

The school also informed Bray that the FBI was investigating, although Bray later learned that the school never filed an official report to police. Bray has since filed his own police complaint.
