Judge Dismisses 3 Lawsuits Against Duquesne U.

PITTSBURGH — A federal judge on Saturday dismissed lawsuits by three former Duquesne University basketball players, who were shot at an on campus dance in 2006. The lawsuits claimed the school didn’t provide adequate security to prevent the shooting.

Shaw James, Stuard Baldonado and Kojo Mensah were three of five players shot during a Sept. 17, 2006 dance sponsored the university’s Black Student Union. The lawsuits stated that Duquesne was responsible for the shooting because the student working the door let the two gunmen inside and failed to alert authorities after the suspects’ friend asked if the men would be frisked upon entering the dance, the Associated Press reports.

However, U.S. District Judge David Cercone’s ruled that Dequesne did provide sufficient security, as two security officers were patrolling the event. Furthermore, Cercone stated that the university is not responsible for the pain, damages and loss of income claimed by the men because it had no specific duty to protect the players.

A judge dismissed a similar lawsuit filed by another victim of the shooting, Sam Ashaolu, who sustained critical head wounds. The gunmen involved in the incident — William Holmes II and Derek Lee — were sentenced to up to 40 and 14 years in prison, respectively.
