Friend Charged in Accidental Student Shooting

BOONE, N.C.

A 20-year-old man has been charged with involuntary manslaughter, a felony, after accidentally shooting and killing his friend at an off-campus party.

Jay Franklin Derby, 20, was fatally wounded after a black-powder muzzleloader rifle discharged. Eli Ruble is being held accountable for the incident. Ruble had intended to scare his friends with the rifle but wasn’t aware it was loaded, reports the Winston-Salem Jounral.

Ruble allegedly told police he had been drinking. Authorities determined the gun did not malfunction and that Ruble was negligent in the shooting death.

Derby was a sophomore attending Appalachian State.
