Dept. of Ed Appeals Dismissal of Va. Tech Fines

BLACKSBURG, Va. — An Education Department attorney has filed an appeal with U.S. Secretary of Education Arne Duncan to uphold the $55,000 in fines levied against Virginia Tech for its response to the 2007 shooting on its campus.

An administrative law judge with the department’s Office of Hearings and Appeals, Ernest Canellos, struck down the fines in March, The Roanoke Times reports. In Education Department attorney Brian Siegel’s appeal, he claimed that Canellos ignored relevant evidence in the case and misinterpreted the legislative intent of the Clery Act.

The state has until June 1 to file a response to the appeal, according to Brian Gottstein, spokesman for the office of the Virginia Attorney General.
