How Would You Classify These Clery Crimes in Your ASR?

Under the Clery Act, Rape is defined as penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.

Since the victim was unconscious, she was unable to give consent, classifying it as Rape. Since it occurred both on-campus and in an on-campus student housing facility, it must be classified as both.

Additionally, since the victim and assailant previously dated, the crime would fall under the Domestic Violence category as well — both on-campus and on-campus student housing facility.
