Test Your FERPA Knowledge: Can This Student Info Be Released?

Answer: No. You cannot give attendance information to the police department. Attendance records are considered part of the students’ education record and cannot be released without the consent of the parents or an eligible student.

Unless the police have obtained legal authority to compel you to disclose the information, it would be a violation of FERPA to share part of the students’ education records.

IMPORTANT NOTE: If the information was related to a health or safety emergency, or attendance records are designated by your school as directory information, then the information could be disclosed without consent.
