Watchdog Group Calls University’s Speech Code ‘Unconstitutional’

CONWAY, Ark. — The University of Central Arkansas’ (UCA) revised its speech code Wednesday after the Foundation for Individual Rights in Education (FIRE) said a portion of it was unconstitutional.

UCA’s speech code, part of the university’s list of “Offenses Subject to Disciplinary Action,” stated students could receive discipline for “annoying” another person on campus. In a blog post, FIRE noted that the First Amendment constitutionally protects such speech.

After reviewing the language in the university’s student handbook, UCA decided to delete the words “annoying” and “disparaging” from the “Offenses Subject to Disciplinary Action” in the 2013-2014 Handbook, campusreform.org reports.
