A student who is already involved in Title IX and Clery complaints against Swarthmore College is once again at the center of another controversy involving the alleged rape of another student.
Mia Ferguson, 19, has been removed from her position as a dorm resident advisor because she would not provide the name of a sexual assault victim whose alleged assailant still lives on campus, reports Phill.com. Ferguson claims she is not required to divulge the identity of the victim and that Swarthmore is retaliating and using Title IX against her.
The college claims Ferguson raised the matter as a safety concern, triggering an obligation by her to identify the victim so Swarthmore officials could investigate the claim.
In May, a group of Swarthmore College students, including Ferguson, filed a complaint with the U.S. Department of Education’s Office for Civil Rights, claiming the administration failed to properly settle sexual assaults. Students allege that school officials attempted to resolve sexual assaults through mediation between aggressors and victims. The group further claimed that administrators discouraged reporting.
In July, Swarthmore College released its interim report on actions it can put in place immediately to address sexual misconduct on campus.
