Mother of Allergic Teen Files Lawsuit to Ban Perfume From School

Published: November 21, 2010

FORT WAYNE, Ind. – A student has suffered from multiple allergic reactions on school grounds, prompting his mother to file a lawsuit against the district. Allegedly, these reactions are being triggered by the perfume and body spray used by other students. Janice Zandi hopes to force Fort Wayne Community High Schools to ban the use of such products on its campuses.

Zandi claims the district’s refusal to ban the products violates the Americans with Disabilities Act (ADA), ABC News reports. Within the last year, her son has been treated for respiratory distress multiple times. On three occasions, he was taken to the local hospital by ambulance.

However, allergists told ABC News that an allergy to perfume or body spray is highly unlikely, given the size of the particles involved. Instead, it is possible that Zandi’s son suffers from asthma and the sprays are aggravating his symptoms.

If Zandi wins her case, the ADA could be opened up to much broader interpretations in the future.
