Liberty U Officer Won’t Face Charges in Fatal Shooting

Prosecutors will not file charges against a Liberty University emergency services officer who shot and killed a student last November.

LYNCHBURG, Va. – Prosecutors will not file charges against a Liberty University emergency services officer who shot and killed a student last November.

The report, prepared by Deputy Commonwealth’s Attorney Jeff Bennett, states that officer A.S. Mulberry acted in self-defense when he shot Joshua Hathaway, 19, on Nov. 19, reports the Roanoke Times.

The incident occurred in a women’s dormitory, where Hathaway approached Mulberry, told him he had been mugged and then attacked the officer with a mallet.

The medical examiner tested Hathaway’s blood post but found no evidence that alcohol or other substances had been consumed.
