OAKLAND, Calif. — Judge Evelio Grillo, an Alameda Superior Court judge, issued a tentative ruling late Thursday that a report on the controversial pepper-spraying incident at UC Davis does not contain any confidential information about campus officers.
The ruling means that the report could be released today, although a potential appeal may delay the release until April 2, The Sacramento Bee reports. Grillo said the report contained a compilation of public information that would have been available to anyone who “took the time and expended the effort to make a Public Records Act request, review videos posted on YouTube and elsewhere, and locate and interview witnesses.”
The union representing the campus officers had argued that releasing the report with officers’ names and information about their conduct is illegal under state laws and court rulings that give California peace officers strong privacy protections.
