Judge: UMW Not Negligent in Rape Case

FREDERICKSBURG, Va. — A Circuit Court judge sided with the University of Mary Washington (UMW) in a ruling on March 28. Judge Gordon Willis determined that the university did not have a legal duty to protect a student who was raped on the campus in 2008.

The $10 million lawsuit filed on behalf of the victim accuses UMW of negligence, the Free Lance-Star reports. Attorney Lewis Lowery, who is representing the victim, has 21 days to file an amended complaint.

The victim, who has since left the university, was walking from her car in a UMW parking garage when she was violently assaulted on Oct. 3, 2008 at 2 a.m. Her attacker has not been found.
