OMAHA, Neb. — More than two dozen students were suspended from Millard South High School for wearing t-shirts and other items to memorize a man shot to death in 2008. The man’s best friend had designed and sold the items to raise money for the shooting victim’s family; the school, however, considered the items to be disruptive and gang-related.
A federal judge ruled last week that Dan Kuhr — the designer of the banned items — and his siblings could take their lawsuit against the Millard School District to a jury, The Washington Examiner reports. The case could determine whether the concern over potential disruptions outweigh students’ constitutional rights to free speech.
In 2008, police determined that Julius Robinson’s death was gang-related, but his family insisted he was not part of a gang.
