California State Senator Joe Simitian has proposed SB20, which would amend the state’s original data breach notification requirement.
The 2003 bill was the nation’s first law requiring consumers be notified when computer data is lost or stolen. According to IDG News Service, however, only about one in 10 breaches are ever publicized.
According to a release authored by Simitian, SB 20 would:
- Establish standard, core content—such as the type of information breached and time of breach—for security breach notices in California;
- Require public agencies, businesses, and persons subject to California’s security breach notification law, if more than 500 California residents are affected by a single breach, to electronically submit the breach notification to the Attorney General; and,
- Require public agencies, businesses and persons subject to California’s security breach notification law, if they are utilizing the substitute notice provisions in current law, to also provide that notification to the Office of Information Security and Privacy Protection at the Department of Consumer Affairs.
