CHRISTIANSBURG, Va. – A hospital security officer’s widow, whose husband was killed by convicted murderer William Morva in August 2006, is suing the Montgomery County sheriff and three officers. She is seeking $9.8 million in damages.
Derrick McFarland was shot and killed inside Montgomery Regional Hospital when Morva escaped police custody. His widow, Cindy McFarland, believes the defendants should have anticipated Morva’s plans of escape given his violent history before taking him to the hospital for treatment.
The lawsuit names Sheriff Tommy Whitt, Capt. Robert Hall, Lt. B.J. Smith and Deputy Russell Quesenberry as defendants. Currently, only Quesenberry has responded back to the lawsuit citing that the victim’s death was based solely on the actions of Morva.
Morva was convicted of capital murder in March. In June, he was sentenced to death.
