A Louisiana judge ruled that Southern University is not liable for an alleged off-campus hazing incident in 2008 that sent two students to the hospital.
That lawsuit alleges students were hazed before a Bayou Classic football game as initiation into the band’s unofficial fraternity Mellow Phi Fellow, according to The Advocate. The incident, which involved students being hit with 2-by-4 boards, took place off campus and trial is set for May 4.
The university’s attorneys argued that the former band leader, Jeremy Dixon, allegedly hazed students outside of his regular duties and that his actions were not permitted by the school.
Attorneys for the former band members who claim to be victims of hazing said they will appeal the judge’s decision. The school could also be found liable for an alleged hazing incident that happened on the university’s campus earlier in 2008.
