Patient With Spina Bifida Claims Sexual Assault, Sues Hospital

GENEVA, Ill. – A woman suffering from spina bifida claims that while being treated for depression at an Illinois hospital, she was assaulted by another patient. The victim is now suing the hospital.

The woman, whose name has not been released, filed the lawsuit Jan. 28. She said the Provena Mercy Medical Center failed to protect her from a patient residing in the psychiatric unit. On Jan. 30, 2006, the male patient allegedly entered her room and sexually attacked her.

The man was not charged with assaulting the woman because police took his psychiatric state into account, according to the woman’s lawyer, Keith Johnson.

The woman seeks more than $50,000 from the hospital.
