The body of a Cox North Hospital security guard, who was kicked in the head by a forensic patient which caused his death, will be exhumed, a Greene county judge ruled, according to KSPR News.
Judge Mike Cordonnier agreed to the request May 14, which was submitted by the lawyer of Jeffrey Bolden, the patient accused of kicking the security officer in the head.
Bolden maintains that Monte Ruby choked him when Bolden was brought to the hospital. Despite the autopsy performed on Ruby’s body before he was buried, doctors had not checked underneath the guard’s fingernails. Bolden’s attorney proposes that evidence that the victim choked Bolden would be beneath Ruby’s fingernails.
Additionally, per KSPR News, the court order granting exhumation stated that Ruby and Bolden knew each other prior to the incident.
Ruby suffered spine and brain injuries as a result of the Aug. 2 incident. He died four days later.
Bolden is charged with second degree murder for Ruby’s death. Currently, no date has been set for the exhumation of Ruby’s body.
