HIV Teen’s Mother Sues School District Over Bullying

INDIANAPOLIS
Published: November 28, 2008

The mother of an HIV-positive student is suing the school district after her daughter was excessively bullied. The Westlane Middle School student was bullied so badly, she was forced to leave school. The lawsuit claims educators did nothing to stop the harassment.

According to the lawsuit, the district violated the Americans with Disabilities Act by allowing the girl’s classmates to call her names, harass her and bully her so much that she was afraid to show up to school.

The suit does not say how the girl contacted the virus. The girl has withdrawn from the district and is being home-schooled.
