CLEVELAND — Drunk-driving charges against a man cited by Cleveland State University (CSU) police were dropped after it was discovered the department’s mutual aid agreement with the city was expired. For a year, campus police lacked jurisdiction off campus and therefore were not able to cite the man.
CSU police responded to an off-campus call last November and found Anthony F. Dibello reeking of alcohol and acting sluggish, Cleveland.com reports. However, when Dibello’s lawyer requested a copy of the department’s most recent agreement with the city, university officials could not locate one.
Between April 2010 and April 2011, no agreement existed between the city and CSU. The lapse could open the department up to the possibility of having cases dismissed.
