WEST LONG BRANCH, N.J. —An appeals court ruling upheld a trial judge’s decision to throw out evidence in a drug case on the grounds that a Monmouth University student’s off-campus residence was illegally searched.
Derek J. Kaltner was charged with drug possession after police said they found two ecstasy tablets in his bedroom when they were responding to a noise complaint, Asbury Park Press reports. But during a pre-trial hearing, a state Superior Court Judge ruled in favor of a defense motion to suppress the drug evidence.
Monmouth County Prosecutor Peter E. Warshaw indicated that it is likely his office will ask the state Supreme Court to review the matter.
