Judge: Tennessee District Showed ‘Deliberate Indifference’ to Sex Abuse
The case revealed that there were several claims of peer-on-peer sexual abuse at the school by two students over two years.
In a civil suit against Robertson County Schools, Judge Todd Campbell found the district to be liable for child-on-child sexual abuse that occurred at East Robertson Elementary School.
The lawsuit was filed by the parents of two former students and then joined by the parent of another student, reports the Tennessean. All three students no longer attend the school.
The case revealed that there were several claims of peer-on-peer sexual abuse at the school by two students over two years. The plaintiffs say that teachers and administrators didn’t take the claims seriously and in some cases punished the alleged victims for reporting the incidents. Additionally, a safety plan designed to protect students from one of their classmates who was identified as sexually aggressive wasn’t followed, which may have led to an attack in a classroom.
Todd also found that parents and other school employees weren’t notified of the abuse.
The plaintiffs were awarded unspecified monetary damages.
